User Agreement for MemoriesNet Album
Welcome to use MemoriesNet Album (hereinafter referred to as “the Application”). Before using the Application, please carefully read this User Agreement (hereinafter referred to as “this Agreement”).
This Agreement is a legally binding agreement between you and the developer of MemoriesNet Album (hereinafter referred to as “we”) regarding your use of the Application. By downloading, installing, registering, logging in, or using the Application, you indicate that you have read, understood, and agreed to all the terms of this Agreement. If you do not agree to any part of this Agreement, please do not use the Application.
- Service Content
This Application is an image album management system designed to help users efficiently categorize, label, manage, and find photos and videos. The main features of this Application include:
• Photo/Video Management: Organize and manage your photos and videos by creating main albums and sub-albums. You can browse, manage, and delete photos and videos from your iPhone album.
• Intelligent Categorization/Labeling: Allows you to create custom labels based on scenes, people, events, items, etc., to categorize and label photos and videos.
• Photo Database: Build a personalized photo and video database management system.
• Precise Search: Search and locate photos and videos based on the labels you set.
• Local Storage: The Application will not upload any of your photos or videos to the server or iCloud. All photos and videos remain stored in your iPhone’s “Photos” app. The album structure and label information created by the Application are stored locally on your device. We do not collect or access any personal photo or video data.
• Backup and Recovery: Provides data backup and recovery features. Your album structure and label data can be backed up to your iCloud storage and restored across different devices. Please note that this backup does not include your actual photos or videos.
- Membership Subscription Services
2.1 Types of Subscription Services:
The “MemoriesNet” album software offers two types of subscription services: VIP User and Super User.
After paying for the membership subscription service, you can continuously enjoy the corresponding user-level privilege services within the service period.
The service period you receive is 365 natural days.
A VIP Monthly Subscription：

B VIP Annual Subscription：

2.2 Cancel Subscription:
For Apple devices, go to “Settings” → “iTunes Store & App Store” → select “Apple ID” → click “View Apple ID” → in the account settings page, click “Subscriptions” → cancel subscription.
- User Rights and Obligations
3.1 Your Rights:
• You have the right to use the features of the Application in accordance with the terms of this Agreement.
• You have the right to manage, modify, or delete the albums, labels, and related information you create in the Application at any time.
• You have the right to enjoy the services provided by the Application under the premise of complying with this Agreement and relevant laws and regulations.
3.2 Your Obligations:
• You agree to abide by all applicable laws and regulations, App Store policies, and the terms of this Agreement when using the Application.
• You agree not to use the Application for any illegal, prohibited, or infringing activities, including but not limited to:
• Storing or sharing any content containing obscene, pornographic, violent, gambling, terrorist, defamatory, insulting, discriminatory, or other illegal content.
• Infringing upon the rights of others, including but not limited to privacy, intellectual property (such as copyright, trademark rights), etc.
• Unauthorized access or use of any part of the Application.
• You are fully responsible for all the content you manage in the Application, including its legality, accuracy, completeness, and truthfulness.
• You understand and agree that, since the Application mainly relies on local storage and album and label data can be backed up to iCloud, you are responsible for backing up your device and ensuring data security. We are not liable for any loss of data due to device loss, damage, data clearing, or other reasons.
- Our Rights and Obligations
4.1 Our Rights:
• We have the right to upgrade, maintain, improve, or suspend part or all of the services of the Application.
• We have the right to modify the terms of this Agreement due to business development or changes in laws and regulations. The modified Agreement will take effect immediately upon publication. If you continue using the Application after the modification, it will be deemed that you accept the modified Agreement.
• If your actions violate this Agreement or any applicable laws, we have the right to suspend or terminate your use of the Application and reserve the right to pursue legal responsibility.
4.2 Our Obligations:
• We will strive to ensure the normal operation and functional stability of the Application.
• We are committed to protecting your data privacy. Please note that the core functionality of the Application is local image and video management, and we will not upload, collect, or share your photos, videos, or any personal sensitive data without your explicit consent. All label and categorization data is stored locally on your device.
- Privacy Policy
This Application respects and protects your privacy. Our privacy policy is an integral part of this Agreement and provides detailed information on how we collect, use, and protect your information. Please read our Privacy Policy carefully, which will be provided separately. The core functions of this Application are based on local data processing, and unless you explicitly agree, we will not collect or upload your personal photos and videos.
- Disclaimer
This Application only provides image management tools and does not assume any responsibility for third-party content infringement, legal disputes, or other liabilities arising from your use of the Application.
We strive to ensure the availability of the service and data security within the scope of technical feasibility, but we cannot guarantee that the service will never be interrupted or completely error-free. We are not responsible for service interruptions or data loss caused by force majeure, network failures, device failures, system maintenance, and other reasons.
You understand and agree that all features of the Application are provided “as is,” and we make no warranties, either express or implied, regarding the Application, including but not limited to merchantability, fitness for a particular purpose, or non-infringement.
We are not responsible for any direct, indirect, incidental, special, consequential, or punitive damages arising from or related to your use or inability to use the Application, including but not limited to loss of profits, data loss, or business interruption, even if we have been advised of the possibility of such damages.
- Intellectual Property
All rights to the Application, including but not limited to copyrights, patents, and trademarks, belong to us. Without our written permission, you may not copy, modify, distribute, display, publish, license, or use any part of the Application in any way.
All content you upload or create in the Application (such as labels, categorization structures, etc.) remains your intellectual property. However, you agree to grant us the necessary rights to process this content (such as local storage, indexing, etc.) in the course of providing the service.
